पुलिस पर action की मांग को लेकर हाईकोर्ट में PIL
बाराबंकी के SRM विश्वविद्यालय में विधि छात्रों पर हुआ था हमला
विधि छात्रों के साथ कथित रूप से बर्बरता करने के लिए उत्तर प्रदेश पुलिस के अधिकारियों के खिलाफ कार्रवाई (action) की मांग को लेकर इलाहाबाद हाई कोर्ट में जनहित याचिका दाखिल कर दी गयी है. बाराबंकी जिले में स्थित श्री रामस्वरूप मेमोरियल विश्वविद्यालय द्वारा गैर-मान्यता प्राप्त लॉ कोर्स के संचालन के खिलाफ शांतिपूर्ण ढंग से विरोध प्रदर्शन कर रहे छात्रों पर हमले को लेकर एडवोकेट आशीष कुमार सिंह द्वारा दायर याचिका में 4 सितंबर की घटना की जांच के लिए एक न्यायिक जांच (एक सेवानिवृत्त न्यायाधीश की अध्यक्षता में) गठित करने की मांग की गई है.
याचिका में कहा गया है कि 4 सितंबर को कैंपस के बाहर प्रदर्शन कर रहे छात्रों की उत्तर प्रदेश पुलिसकर्मियों द्वारा कथित रूप से बेरहमी से पिटाई की गयी. पेशे से वकील याचिकाकर्ता ने दलील दी है कि पुलिस ने बिना किसी उकसावे के पुरुष और महिला कानून के छात्रों की पिटाई की. यहाँ तक कि पुरुष पुलिसकर्मियों ने भी कानून, मर्यादा और गरिमा की पूरी तरह अवहेलना करते हुए महिला छात्रों के साथ मारपीट और दुर्व्यवहार किया.
कथित घटना को गंभीर संवैधानिक चिंता का विषय बताते हुए जनहित याचिका में कहा गया है कि पुलिस की कथित कार्रवाई (action) ने संविधान के अनुच्छेद 14, 15, 19 और 21 के तहत छात्रों के मौलिक अधिकारों का उल्लंघन किया है.

याचिकाकर्ता ने तर्क दिया है कि कथित घटना से संबंधित जाँच वरिष्ठ पुलिस अधिकारियों को सौंपने का सरकार का निर्णय मनमाना और प्राकृतिक न्याय के सिद्धांतों के विपरीत है. कहा गया है कि यह एक व्यक्ति को अपने मामले में न्यायाधीश बनने की अनुमति देता है.
जनहित याचिका में यह भी रेखांकित किया गया है कि श्री रामस्वरूप मेमोरियल विश्वविद्यालय कथित तौर पर बार काउंसिल ऑफ इंडिया से उचित अनुमोदन के बिना कानून के पाठ्यक्रम चला रहा है, जिससे सैकड़ों छात्रों का करियर खतरे में पड़ सकता है.
याचिका में एक न्यायिक आयोग के गठन की मांग की गई है जो मामले की जाँच करे और संबंधित पुलिसकर्मियों के खिलाफ आपराधिक मुकदमा चलाने (action) और विभागीय कार्रवाई की सिफारिश करे. याचिका में रामस्वरूप मेमोरियल विश्वविद्यालय और अन्य संस्थानों को बीसीआई मान्यता के बिना विधि पाठ्यक्रम चलाने से रोकने और घायल छात्रों के चिकित्सा उपचार, मुआवजे और पुनर्वास सुनिश्चित करने का भी अनुरोध किया गया है.
यह मामला 8 सितंबर को हाई कोर्ट की लखनउ बेंच के जस्टिस राजन रॉय और जस्टिस मंजीव शुक्ला की पीठ के समक्ष आया तो पीठ ने पाया कि यद्यपि रामस्वरूप विश्वविद्यालय के खिलाफ राहत मांगी गई थी लेकिन उसे पक्षकार नहीं बनाया गया था. बेंच ने याचिकाकर्ता को मामले में विश्वविद्यालय को प्रतिवादी बनाने की अनुमति देते हुए मामले की सुनवाई 12 सितंबर तक के लिए स्थगित कर दी.
